i bought an old lifted up off road truck that broke down right after i got it?

i bought it out of town so it was dark when i got there to look at it. when i bought it i drove it under 30 for 5 miles before the transmission overheated and pretty much quit. i called the guy i bought it from he said it wasnt his fault but he told me and advertised it to be in good working condition. would i stand a chance agianst him if i went to court

    Not a hope in heck, it is "buyer beware" when it comes to private purchases of used vehicles. Sorry.

    If it drove for you, it was running to your satisfaction when you left.

    There can be many reasons it quit, some could be minor and easily remedied, but we don’t have enough information to help with that either.

    You bought it as is…no warranty or anything. Instead of wasting the money on a lawsuit that you most likely wont win, use the money to fix the truck

    Maybe, bring the add with you to court.If it says it was in working order.You have to serve him a summons but you need to have a friend
    give it to him.Have him say "this is for you",only.Then leave.
    However if it said "as is" tough luck.You should be wary when buying things.You really have to take it to a mechanic to check it before you buy it.

    unless he made a statement in writing and a warrenty your screwed
    sold as is where is. old saying buyer beware.. hope ya didnt pay to much for it? was it a automatic tranny or manual. if it dont move its shot but if its a automatic could be a simple tranny filter. manual could be the clutch. sorry you had to learn a hard lesson some pepole dont care as long as they have your money.
